For the purposes of these terms and conditions, “Us”, “Our”, “We”, "ONE HEALTH", "Site", ONE HEALTH Training", refers to onehealthtraining.com.au and the business "ONE HEALTH - Health training". “You” and “Your” refers to you, the client, visitor, website user, course participant/practitioner/student, or person using our website.
AMENDMENT OF TERMS
We reserve the right to change, modify, add or remove portions of these terms at any time. Please check these terms regularly prior to using our website to ensure you are aware of any changes. We will endeavour to highlight any significant or substantive changes to you where possible. If you choose to use our website then we will regard that use as conclusive evidence of your agreement and acceptance that these terms govern your and onehealthtraining.com.au’s rights and obligations to each other.
LIMITATION OF LIABILITY
It is an essential pre-condition to you using our website that you agree and accept that onehealthtraining.com.au is not legally responsible for any loss or damage you might suffer related to your use of the website, whether from errors or from omissions in our documents or information, any goods or services we may offer or from any other use of the website. This includes your use or reliance on any third party content, links, comments or advertisements. Your use of, or reliance on, any information or materials on this website is entirely at your own risk, for which we shall not be liable.
It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific, personal requirements. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
COMPETITION AND CONSUMER ACT
For the purposes of Schedule 2 of the Australian Consumer Law, in particular Sections 51 to 53, 64 and 64A of Part 3-2, Division 1, Subdivision A of the Competition and Consumer Act 2010 (Cth), onehealthtraining.com.au’s liability for any breach of a term of this agreement is limited to: the supplying of the goods or services to you again; the replacement of the goods; or the payment of the cost of having the goods or services supplied to you again.
onehealthtraining.com.au handles returns and processes refunds in accordance with the Australian Consumer Protection legislation.
Should you wish to receive a refund, please notify us within 7 days of purchase with a valid reason for refund. If we are unable to resolve your complaint or further assist you, we will process a refund. Refunds will be processed promptly and payment made by the same method that you made payment. All refunds are made at the discretion of onehealthtraining.com.au. See the EDUCATION section in these terms for more specific details.

onehealthtraining.com.au may from time to time provide on its website, links to other websites, advertisements and information on those websites for your convenience. You may change your details at any time by advising us in writing via email. All information we receive from our customers is protected by our secure servers. onehealthtraining.com.au’s secure server software encrypts all customer information before it is sent to us. Furthermore, all customer data collected is secured against unauthorized use or access. Credit card information is not stored by us on our servers.
We do not and will not sell or deal in personal or customer information. We may however use in a general sense without any reference to your name, your information to create marketing statistics, identify user demands and assist in meeting customer needs generally. In addition, we may use the information that you provide to improve our website and services but not for any other use.
DISCLOSURE OF INFORMATION
onehealthtraining.com.au may be required, in certain circumstances, to disclose information in good faith and where onehealthtraining.com.au is required to do so in the following circumstances: by law or by any court; to enforce the terms of any of our customer agreements; or to protect the rights, property or safety of our customers or third parties.
EXCLUSION OF COMPETITORS
If you are in the business of creating similar documents, goods or services for the purpose of providing them for a fee to users, whether they be business users or domestic users, then you are a competitor of onehealthtraining.com.au. onehealthtraining.com.au expressly excludes and does not permit you to use or access our website, to download any documents or information from its website or obtain any such documents or information through a third party. If you breach this term then onehealthtraining.com.au will hold you fully responsible for any loss that we may sustain and further hold you accountable for all profits that you might make from such unpermitted and improper use. onehealthtraining.com.au reserves the right to exclude and deny any person access to our website, services or information in our sole discretion.
COPYRIGHT, TRADEMARK AND RESTRICTIONS OF USE
This website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance, trademarks and graphics. You are not permitted to reproduce the documents, information or materials on the website for the purposes of sale or the use by any third party. In particular you are not permitted to republish, upload, transmit electronically or otherwise or distribute any of the materials, documents or products that may be available for download from time to time on this website.

Any redistribution or reproduction of part or all of the contents in any form is prohibited other than the following: you may print or download to a local hard disk extracts for your personal and non-commercial use only; and you may copy the content to individual third parties for their personal use, but only if you acknowledge the website as the source of the material.

These terms and conditions represent the whole agreement between you and onehealthtraining.com.au concerning your use and access to onehealthtraining.com.au’s website and your use and access to the documents and information on it. No other term is to be included in this agreement except where it is required to be included by any legislation of the Commonwealth or any State or Territory. All implied terms except those implied by statute and which cannot be expressly excluded are hereby expressly excluded.
EXCLUSION OF UNENFORCEABLE TERMS
Where any clause or term above would by any applicable statute be illegal, void, or unenforceable in any State or Territory then such a clause shall not apply in that State or Territory and shall be deemed never to have been included in these terms and conditions in that State or Territory. Such a clause if legal and enforceable in any other State or Territory shall continue to be fully enforceable and part of this agreement in those other States and Territories. The deemed exclusion of any term pursuant to this paragraph shall not affect or modify the full enforceability and construction of the other clauses of these terms and conditions.
This agreement and this website are subject to the laws of NSW and Australia. If there is a dispute between you and onehealthtraining.com.au that results in litigation then you must submit to the jurisdiction of the courts of NSW.
By using our services, you agree that onehealthtraining.com.au is not to be held liable for any decisions you make based on any of our services or guidance and any consequences, as a result, are your own. Under no circumstances can you hold onehealthtraining.com.au liable for any actions you take nor can you hold us or any of our employees liable for any loss or costs incurred by you as a result of any guidance, advice, coaching, materials or techniques used or provided by onehealthtraining.com.au.
All our information on both the website and in consultations is intended to assist you and does not in any way, nor is it intended to substitute professional, financial or legal advice. Results are not guaranteed and onehealthtraining.com.au takes no responsibility for your actions, choices or decisions.
ONE HEALTH - Health Training reserves the rights to deny or cancel any participant for any reason whatsoever who either enrolls or intends to enroll on any of our provided courses.
TERMS & CONDITIONS SPECIFIC TO OUR COURSES AND COURSE CONTENT
COURSE SPECIFIC DEFINITIONS
'Functional Biomechanical Assessment & Treatment with Neuromuscular Retraining Course' means: 16-hrs training consisting of 2 consecutive days (TBC on individual course pages in this Site from 8.30am-5.30pm (including 2x15-min breaks and 1-hr lunch)
'Advanced Soft Tissue Manipulation Course' means: 16-hrs training consisting of 2 consecutive days (TBC on individual course pages in this Site) from 8.30am-5.30pm including, 2x15-min breaks and 1-hr lunch
'Advanced Joint Manipulation Course' means: 16-hrs training consisting of 2 consecutive days (TBC on individual course pages in this Site) from 8.30am-5.30pm, including 2x15-min breaks and 1-hr lunch
'Advanced Joint Articulation Course' means: 16-hrs training consisting of 2 consecutive days (TBC on individual course pages in this Site) from 8.30am-5.30pm, including 2x15-min breaks and 1-hr lunch
'Student Workshops and Courses' may vary in length of course and hours of operation, as these are designed to be specific to each groups requirements. Each event will be detailed with you the User prior to course booking.

ONE HEALTH TRAINING COURSES
When You book a course with ONE HEALTH, and when You attend any of the ONE HEALTH courses, You are agreeing to abide by, comply with and be bound by the following terms and conditions.
50% payment is required at the time of initial booking of each course. Full payment is required 14 days prior to commencing any course.
All participants must have command of the English language and communication skills. This is for the purpose of understanding the content and to participate in our courses.
We reserves the right to refuse a booking on the basis that the participant's qualifications & prior experience is not sufficient to safely practice on others during the practical course as well as on clients/patients after the course.
A period of 48 hours is normally required following enrollment and attending a course. This is to allow for completion of all administration requirements and to ensure eligibility to attend a course. Please contact us if you would like to enroll less than 48 hours prior to the course.
Your place is confirmed once you receive a receipt from us by email.
This receipt commences a binding agreement between "You" and "Us".
Advanced Joint Manipulation Course
ONE HEALTH - Health Training's Advanced Joint Manipulation Course is available to Osteopaths, Physiotherapists, Chiropractors and Medical Doctors only*, who are registered with their appropriate governing bodies of the country of their origin (AHPRA in Australia). however only Australian registered practitioners are able to perform cervical manipulations under Australian law. If not registered in Australia, a copy of each participant's relevant qualification and current registration is required 48-hrs prior to course commencement. Cervical manipulations will not be able to be practiced or performed (to the point of 'thrust' or joint cavitation) from any practitioner not registered in Australia.
*This course is also available to Physiotherapy, Osteopathy, Chiropractic and Medical undergraduate students who are in their final year of study. Cervical manipulations are not allowed to be taught or performed by undergraduates unless under supervision by a specific AHPRA registered University. All other joint manipulations may be taught and practiced and cervical manipulation techniques can be practiced up to, but not performing, the 'thrust' element. Undergraduates are unable to use any techniques taught on these courses to clients/patients until they have obtained professional indemnity insurance that covers them for such techniques (when they are a qualified and registered practitioner).
It is the responsibility of the participant to ensure they have the relevant qualification to join their chosen course.

Advanced Soft Tissue Manipulation Courses
These courses are available to Physiotherapists, Osteopaths, Chiropractors, Myotherapists, GP's, Sports Massage Therapists, Remedial Massage Therapists, Occupational Therapists, Podiatrists, Musculoskeletal Therapists and Registered Nurses.
These courses are also available to Physiotherapy, Osteopathy, Chiropractic, Myotherapy, Medical and Podiatry undergraduate students who are in their final year of study. Undergraduates are unable to use any techniques taught on these courses to clients/patients until they have obtained professional indemnity insurance that covers them for such techniques, unless they have prior qualifications that qualifies them to do so.
Student Workshops and Courses
These courses are available to Physiotherapy, Osteopathy, Chiropractic, Myotherapy, Medical and Podiatry undergraduate students who are in their final year of study.
Undergraduates are unable to use any techniques taught on these courses to clients/patients until they have obtained professional indemnity insurance that covers them for such techniques, unless they have prior qualifications that qualifies them to do so.
Professional Indemnity Insurance
We advise all participants to check that they will be able to perform techniques learnt on the course with their professional indemnity insurer before joining the course.
ONE HEALTH will teach techniques in accordance with Australian law and holds no responsibility for any issues arising regarding insurance of participants with regard to any information and techniques taught on our courses.
Payment of course fees
On initial booking, you are required to pay 50% of the course fees as a deposit
Full payment of your course fees are required to be paid 14 days prior to the commencement of your selected course (less any discounts that may apply at the time)
All course fees are quoted in Australian Dollars (AUD) & are inclusive of Australian GST
All payments must be made in Australian Dollars (AUD)
All course payments are made through ONE HEALTH's website via an external secure payment provider. You can pay via the external secure payment provider using your credit/debit card as per their terms and conditions
An external secure payment provider's receipt will be sent to you via email after payment
ONE HEALTH holds no credit/debit card details
ONE HEALTH cannot be held liable for any issues related to credit card payments where there has been misuse or fraud
Confirmation of your booking will be sent to you via email
Course fees must be paid in full before participation on the course
Cancellation T & C's
This only applies to initial cancellation of bookings and not transferring or postponing your course.
See 'Transferring your course T & C's' below
More than 28 days notice from an initial course commencement date; 50% of the course fee will be required
28 days to more than 14 days notice from an initial course commencement date; 75% of the course fee will be required
14 days notice from an initial course commencement date; 100% of the course fee will be required
If you Cancel your course after transferring from a previous course; 100% of the course fee will be charged to the user. If partial payment has been made, no refund can be made regardless of the time prior to the later course commencement.
All course refund requests must be accompanied with your invoice / receipt of payment details
Refunds will be made within 14 days of receipt of your written request (if approved by onehealthtraining.com.au).
Cancellation of a course by us
It is unlikely that we will cancel a course, but in the event that We do, we will provide you with as much notice as possible.
We will refund payments with respect to practical course fees, less any bank or credit card processing fees.
We will not be liable for losses incurred such as accommodation bookings, travel arrangements or any other costs incurred by the user other than the course fees themselves. Therefore it is strongly suggested by us that course enrollee's make flexible accommodation and travel bookings.
If an unforeseen circumstance, such as war, riot, industrial dispute, terrorist activity, natural or nuclear disaster, fire or adverse weather conditions occurs, a decision will be made by Us regarding refunds. We will not be liable for any other losses or costs incurred.
Transferring your Course T & C's
You may transfer to another course if you are unable to attend a particular course under the following terms and conditions
There is a $100.00 Transfer Fee each time a course transfer is requested
All courses need to be completed within 12 months of enrollment on the first occurs
If a practitioner has not completed the course within that 12 months, they will need to re-enroll on another course and pay the standard course fee for that course
Transfer places are not guaranteed until the transfer fee has been received.
Practitioners will be offered the next available practical course place.
Transferring your course enrollment to a colleague
It is possible to transfer your place on a course to a colleague who will take your place on the course you are register on. A $100 transfer fee will apply and all pre-requisites apply for the transferee
Transferring your course due to medical reasons
ONE HEALTH - Health Training's courses require, the full attended training hours (specific to each course) to be completed over one single practical course, i.e. 2 consecutive days:
If a practitioner is sick and unable to attend, they must produce a Doctor's Certificate in order to defer their course enrollment to the next available course.
If a practitioner becomes ill during or after attending the first day (of a 2-day course) and is unable to attend the second day, they must produce a Doctor’s Certificate in order to defer their course enrollment to the next available course.
There is no charge to defer a course due to medical reasons.
If a practitioner has attended part or all of the first day (of a 2-day course) and is unable to attend the second day for any other reason, they can defer their course enrollment to the next available practical course.
The fee for deferment is 50% of the full cost of the course.
Participants who enroll and pay for a course but are deemed ineligible to attend by the course presenter for any reason, will be unable to apply for a refund.
Reasons for ineligibility are (but not limited to) the following:
Failure to meet English Language requirements
Failure to meet course pre-requisites
Non or Late Attendance
Applies to the following:
Late attendance to your course
Failure to attend your course without appropriate notice
If either of the above occur; your fees cannot be refunded.
If attending late, you may still be able to attend the remainder of the course at the discretion of the course presenter, however if you are allowed to continue on the course, your CPD hours will be reduced accordingly on your certificate.
Postponing your course
When booking your course with us, 50% of the course fee is required upon booking as a deposit. If you decide to postpone your course, you must notify us and we will refund you your course deposit minus the postponing fee (below). All credit / debit card processing fees incurred by you and us will also be charged to you.
A participant can only postpone their enrollment once, and for a maximum of 12 months from the postpone date.
If a participant has not completed a course within that 12 months from the postpone period, they will need to re-enroll on another course and pay the full relevant fees for that course.
Postpone admin fees
The postpone admin fee of $100.00 is payable as soon as a participant is ready to transfer their enrollment to another course.
Any postpone transfer will incur a $100.00 transfer fee for every transfer, regardless of the time before course commencement.
To transfer to a course after being postponed, the participant must inform us which course they would like to attend and pay the appropriate admin fee as above.
The practitioner will be transferred to the course dependent on availability.
Please be aware that once a participant postpones their course enrollment and then wishes to cancel their course enrollment, there will be a fee of 100% of the total course fee.
ONE HEALTH reserve the right, for whatever reason and without the permission of the participants, to postpone a participants enrollment
A $50 administration fee applied to all refunds.
All course refund requests must be accompanied with your invoice / receipt details
The refund will be issued minus any of our fees above and any credit / debit card processing fees.
Refunds will be made within 14 days of receiving the written request.

To receive a discount, the discount code must be applied at the time of purchase.
It is the participant's responsibility to ensure that all relevant fields are entered on the registration page and updated by the participant accordingly.
From time to time ONE HEALTH - Health Training announces special offers and discounts that you can apply for.
If a discount is advertised or offered after you have enrolled and paid your deposit on a course, this discount cannot be offered to you. ONE HEALTH reserves the right to offer discounts at any stage for any reason
Course Package Discount: this discount cannot be used in conjunction with any other offer / discount, except an authorised Gift Voucher.
Refer a Friend (a discount that is offered occasionally at the digression of ONE HEALTH - see 'Refer a Friend policy' for details)
Waiting list policy
Participants can register and place themselves on a waiting list if their chosen course date is full.
No payment is necessary until participants have enrolled on the course.
When participants are placed on a waiting list, they do not have a place on that course until they are contacted by us, informing them of an available place on their chosen course.
If a space becomes available 2 weeks before the course start date:
We will endeavour to contact waiting list participants via email/phone, in the order that they are on the waiting list.
We will allow 24 hours for anyone we have contacted, to contact us before releasing the space to our website.
If a space becomes available 10 days before the practical course start date:
We will email everyone on the waiting list & allow 24 hours for anyone to contact us.
After that time we will remove all those on the waiting list & release the space to our website, thereby allowing any eligible person to book the space whilst it remains available.
If a space becomes available less than 5 days before the practical course start date:
We will email everyone on the waiting list to inform them of the space.
We will then remove all those on the waiting list and release the space to our website, thereby allowing any eligible person to book the space whilst it remains available.
ONE HEALTH - Health Training reserves the right to remove anybody from any waiting list according to the above policy.
You can purchase gift vouchers from us at any value from $50 and up. Gift vouchers can be used towards any course costs. They will be sent electronically and will contain a unique code.
To receive any discount, the discount code / gift voucher code must be applied at the time of course purchase.
Refer a Friend policy
If you are a previous participant on a ONE HEALTH course, You will be eligible for our 'Refer a Friend' policy'.
If you have attended any of our courses (as a paid participant), you will be given a 'Refer a Friend' voucher. If your friend enrolls on one of our courses (within the remit of our policy below), you & your friend will receive the following reward:
Your friend's reward - $75 off any ONE HEALTH - Health Training course they enroll & pay for. After entering the Discount Code (on the checkout page) provided by you (given to you on your recently completed course) the discount will be applied and reduce the cost of their course.
Your reward - you will receive a Gift Voucher worth $75 off any course provided by ONE HEALTH Training (provided you meet the course pre-requisites) when your friend enrolls & pays for any course within 1 month of your course completion.
Your $75 gift voucher can be used in addition to any current discount / offer that may be available at the time of booking. When the gift voucher code is added on the checkout page, the discounted course price will be automatically calculated at that time.
To receive your Gift Voucher, please provide us with details of who you have referred. When we can confirm your friend has booked on one of our courses, we will then send you a gift voucher that can be used towards your next course (valid for 12 months after your friend's purchase).
You can use your $75 discount towards our upcoming courses once the course date has been posted on our website.
One reward redeemable per course.
Should you wish to participate on a course you have already attended within 12-months of completing the initial course, you can, at a fee of 50% of the initial full course cost. If, for whatever reason the same course is not available or no longer provided, you will not be able to refresh to a different or similar course for the same 50% fee.
This excludes any student participating on our Student Workshop Courses, as these courses are usually heavily subsidised.
Refresher places are dependent on availability. We are unable to confirm refresher course places until 1 (one) week before the course commences.
A Certificate of Completion will be provided on successful completion of a course and if full payment has been received. It will be emailed within 10 working days and posted (if required) within 14 days.
Each student that attends a ONE HEALTH course must complete a Health & Consent Form at least 7 days prior to attending the course. Failure to do so may disqualify attendance.
ONE HEALTH reserves the right to not award a participant with a certificate of attendance should the instructor feel that the participant has not met the required attendance and or standard.
ONE HEALTH reserves the right to refuse a booking on the basis that a participants qualifications & prior experience is not sufficient in order to safely practice on others during the course as well as patients after the course.
ONE HEALTH practical components require that each participant act as a model for another participant. They must be willing to do so in order to attend the practical session. They must also be physically able to take part in all practical sessions.
ONE HEALTH reserves the right to remove any participant from a course if their behaviour is deemed by the tutor to be detrimental to the group, unsafe or adversely affecting the groups' enjoyment.
ONE HEALTH will not be liable for any refund in any of these above mentioned circumstances.
Participants personal property
ONE HEALTH - Health Training cannot be held responsible for damage and /or loss to your personal property while attending a course.
Social media, video, audio & photography
ONE HEALTH Training reserves the right to record video of any / all practical elements of our courses. The purpose of recording these practical elements is to provide important feedback to practitioners, improve products, promote courses (including but not limited to social media) and for research. The video recordings / photographs will be made available to each participant on request.
Participants who attend a ONE HEALTH - Health Training course who do not wish to be photographed / filmed need to advise us in writing 48 hours prior to the start of the course.
We welcome you to take your own recordings of techniques being used throughout the course but ONE HEALTH Training reserves the right to have access upon request any recording or copies of recordings you have made during the course. We also reserve the right to insist that any recordings made by you during the course, be made for your sole individual use and not to be displayed on any public forum, including but not limited to Instagram, Facebook, Twitter, YouTube, Google or any internet site.
